a. General
By entering the FIELDERS Footy Tipping competition,
you acknowledge that you have read and agree to the following Terms and
Conditions. The references in these rules and terms and conditions to FIELDERS
Footy Tipping means references to FIELDERS AUSTRALIA Pty Ltd and all groups or
affiliated companies thereof, including HILLS INDUSTRIES LIMITED and DEADLINE
SERVICES PTY LTD t/a DEADLINE MEDIA. FIELDERS Footy Tipping competitions
are void where prohibited by the local law in your country but are otherwise
subject to Australian Law.
The competition is offered as
a FREE game to all participants and users of the web site, and none of the
FIELDERS Footy Tipping competitions are to be used in connection with any form
of gambling or the promotion of gambling.
b. Entry - how to enter
To enter, participants must first complete the online
registration at the FIELDERS Footy Tipping web site. There are no
charges for registration and all games are provided free of charge. Once registered,
participants are expected to check the FIELDERS Footy Tipping web site
regularly and enter their tips before 6pm EST of each tipping round. No
responsibility whatsoever will be taken if participants are unable to enter
their tips on an occasion for any reason.
Tippers may enter the competition up to the closing time of April 11, 2008.
Late entrants before this date will be given the accumulated total of the
lowest scores recorded during the previous round(s), but not more than 4 points
per round. There will be no intake of entrants past this date.
All entries become the
property of the FIELDERS Footy Tipping and its affiliated partners.
c. Term of competition
The term of each competition
is based on such circumstances as to when the sport is in season and as
appropriate for the type of game, and is indicated in appropriate areas of this
web site as relevant to the sport in question. Winners will be judged and
announced FIELDERS Footy Tipping, through a link to be announced
on the front page of the respective sports front page, a reasonable time frame
for each competition.
NRL
Duration of Promotion:
Competition commences Friday 14th March 2008 and concludes Monday 8th September
2008 in accordance with the 2008 National Rugby League Season.
d. Entrants
To be eligible for this competition, you must be a client
or customer of FIELDERS AUSTRALIA Pty Ltd or an employee of a company or
organisation that is a client or customer of FIELDERS AUSTRALIA Pty Ltd.
The minimum age of an eligible entrant is 18 years at the time of commencement
of the competition.
Entrants not eligible to be awarded any prizes for participation in these
contests include:
(i)
employees and ex-employees of, or contractors to, FIELDERS AUSTRALIA Pty Ltd and DEADLINE SERVICES PTY LTD t/a Deadline Media, the Promoter or any of its
agencies involved with this competition, or non client or non customers of FIELDERS
AUSTRALIA Pty Ltd,
(ii) members of the immediate family of such employees and contractors, and
(iii) international participants who are not residents of Australia.
"Immediate family" means spouse, de facto spouse, parent, natural or
adopted child, and sibling (whether natural or adopted by a parent), whether or
not they live in the same household as the employee/contractor.
All entrants and competition
winners consent to the use of his or her name, suburb of residence and image
for promotional and marketing purposes and agree to participate in reasonable
promotional activities as requested by the FIELDERS Footy Tipping and
related promoters.
FIELDERS Footy Tipping and affiliated partners reserve the right to
limit the number of entries in the competition(s) at any time for any reason.
e. Rules
1. To enter the FIELDERS Footy Tipping competition, a tipper must
register on the FIELDERS Footy Tipping website accessible via a link from the www.fielders.com.au home page
2. The FIELDERS Footy Tipping competition is via the web site only.
That is, participation in the competition is only possible via the FIELDERS
Footy Tipping website. Entries will not be accepted or processed via email,
facsimile telephone, in writing or in any format other than via the web site.
3. When registering, all compulsory fields must be completed. The
compulsory fields are:
a. Name
b. Email address
c. Occupation
d. Company
e. Contact telephone
f. Address
4. A reminder email for the next round will be sent out mid-week to
help web site users get their tips in on time.
5. Tipping closes at 1 hour before the start of play of the first game
of the round. This is usually a Friday evening, but may include any mid-week
fixtures. Tips cannot be changed once the tipping closes for a round.
6. One point is scored for a result where a website user correctly
tips a win or a loss. Two points are scored for:
a. a correct tip of the "game of the week",
b. a correct tip of a draw
c. a correct tip of the margin
The maximum possible points scored in a situation where the "game of the
week" is a draw is 4 points.
7. Failure to tip during a week will result in automatic selection of
all away games, and
a. 60 points for the margin tip in the AFL "game of the week", or
b. 30 points for the margin tip in the NRL "game of the week"
Also, the maximum score for the round in which an automatic selection is made
will be 4 correct tips. This means that even if all the 8 away games in a round
were correct, the web site user will only receive 4 points.
Further, if no tips are entered for a total of 8 rounds, it will be assumed
that the tipper is not participating in the competition and their record will
be deleted.
8. Default tip notice: once tipping closes, the server will check to see whether
any web site users have forgotten to tip and send them the default away game
tips.
9. Late entry: tippers may enter the competition up to the closing
time for round 5 picks. Late entrants will be given the accumulated total of
the lowest scores recorded during the previous round(s), but not more than 4
points per round.
10. Results will be published as soon as the results of all fixtures
have been added to the site. Normally, this will be by 10am Australian Eastern
Standard time on the Monday morning immediately after the round. The website
may be unavailable while results are being processed.
11. The winner from each nominated round will be the tipster with the
most outright tip points in addition to being the closest to the winning margin
of the "game of the week". If there is more than one winner per group
in a given nominated round, a random draw will decide the winner.
12. The "game of the week" will be selected by the FIELDERS
Online footy tipping management team and nominated at the start of the season.
13. Unless otherwise stated, web site users are predicting the results
after any extra-time or over-time is played if applicable.
14. The overall winner will be the web site user with the highest total
number of correct tips at the end of the competition(s) minor round. If there
is more than one winner, the best cumulative "game of the week"
margin tips across the minor round will decide the winner.
15. In the event of a tie, where a clear winner cannot be determined by
the aforementioned methods, a random draw will be conducted to determine a
clear winner.
f. Prizes
By participating, participants
agree that the decisions of FIELDERS Footy Tipping in the selection of
winners and awarding of prizes will be final and binding in all matters
relating to the FIELDERS Footy Tipping competitions.
Prizes awarded, and any
related rules, regulations and permits relating to prizes and giveaways will be
published on pages detailing and according to prizes given away on a case by
case basis, on announcement of full prize list.
All prize items are valued inclusive of GST and FIELDERS
Footy Tipping take no responsibility for any variations in item values. The
prizes are not transferable, exchangeable or redeemable for cash. In the event
that any prize item is unavailable, FIELDERS Footy Tipping reserves the right
to substitute a prize item of equal or greater value. Any taxes which may be
payable as a consequence of a winner receiving a prize are the sole
responsibility of the winners. An eligible participant may only receive a
maximum of one (1) periodical prize during the term of the FIELDERS Footy
Tipping season, where appropriate. Subject to the terms of these Official Rules
and Regulations, an eligible participant may also receive only a single prize
among the grand prizes awarded on the conclusion of the competition FIELDERS
Footy Tipping is not responsible for and shall not be liable for late, lost,
misdirected or unsuccessful efforts to notify prize winners.
NRL
Details of Prizes:
Major draw prize is one 32” Phillips LCD TV with a retail value of $1349. First minor round prize is one Canon 7.1 Mega pixel Digital Camera with a retail value of $179. Second minor round prize is one Phillips DVD Homes Theatre System with a retail value of $299. Third minor round prize is one Navman GPS System with a retail value of $339. Fourth minor round prize is one IPOD Touch 8GB with a retail value of $416. Total prizes valued at $2,582. Prizes are not redeemable for cash.
Details of Winner Determination:
The winner of each nominated round prize is determined by
the leading tipper at the end of the selected round and the major prize winner
is determined by the leading tipper at the end of the season. Nominated minor
rounds are 6, 12, 18 and 24. 6 being the 1st minor nominated round
through to 24 being the 4th minor nominated round.
The winner for the major prize will be announced at 12pm on the 9th September 2008 at Fielders Australia’s Head Office, located at 15 Railway Terrace, Mile End South SA. First minor round prize will be announced after round 6 at 12pm on 22nd April 2008. Second minor round prize will be announced after round 12 at 12pm on 3rd June 2008. Third minor round prize will be announced after round 18 at 12pm on 15th July 2008. Fourth minor round prize will be announced after round 24 at 12pm on 26th August 2008. All minor round prize winners will be announced at Fielders Australia’s Head Office, located at 15 Railway Terrace, Mile End South SA.
Provision for Unclaimed Prizes:
If any prize is not claimed within 3 months of the draw
date, an unclaimed prize draw will be conducted at 12pm on 12th December 2008 subject to any written directions given under Reg 37 of the
Lottery and Gaming Regulations 1993 (SA). This result will be published in the
Australian national newspaper on 16th December 2008.
g. Selection
and notification of winners
Within a reasonable time frame of the end of the respective
competitions the eligible entrants that have earned the highest number of
points in the competition(s), will be declared the winners.
FIELDERS Footy Tipping and
the related Promoters reserve the right to disqualify any entrant submitting an
entry which, in the opinion of the judges, is not a client or customer of
FIELDERS AUSTRALIA Pty Ltd. The judges' decision(s) is final and no
correspondence will be entered into.
In the event of a tie, where a clear winner cannot be
determined by the aforementioned methods, a random draw will be conducted to
determine a clear winner.
The winners will be notified by email, using the details
provided in their entry, and the name and suburb of the winners may be published on
the web site.
Winner Notification:
The winner of the major prize will be notified via the Fielders website (www.fielders.com.au) and by mail within 14 days after the
draw. The name and suburb of the major
prize winner will be published in the Australian national newspaper on 23rd
September 2008. All minor round prize
winners with the prize value over $100 will be notified via the Fielders
Website (www.fielders.com.au) and by mail within 14
days as well as in the Australian newspaper on the following dates: 1st Minor 6 th May 2007, 2nd Minor 17th June 2008,
3rd Minor 29th July 2006 and 4th Minor 9th September 2007.
h. Liability
Participants release FIELDERS Footy Tipping and its
officers, directors, agents and employees from all liability of any kind
concerning FIELDERS Footy Tipping competitions or any prizes awarded.
FIELDERS Footy Tipping accepts no responsibility for any
statements, material or other submissions placed on this Web site by users or
any third party, or for any loss or damage resulting from your breach of these
Terms and Conditions.
FIELDERS Footy Tipping reserves the right in its sole
discretion to cancel or modify FIELDERS Footy Tipping competitions or modify
these Terms and Conditions Official Rules at any time without notice, subject
to state legislation.
FIELDERS FOOTY TIPPING makes no representations or
warranties as to the quality/suitability/merchantability of any of the
goods/services offered as prizes. To the extent permitted by law, FIELDERS
FOOTY TIPPING is not liable for any loss suffered or sustained, to person or
property and including, but not limited to, consequential (including economic)
loss by reason of any act or omission, deliberate or negligent, by FIELDERS
FOOTY TIPPING, or its servants or agents, in connection with the arrangement
for supply, or the supply, of any goods or services by any person to the prize
winners and, where applicable, to any family/persons accompanying the winners.
i. Conduct
and disqualification
FIELDERS Footy Tipping reserves the right to disqualify players who attempt to tamper with the normal
operation of the game. Such players will be ineligible for current and, at our
discretion, future entry in or prizes for winning the competitions.
j. Traders

The trader holding the competition is FIELDERS Australia Pty Ltd. Fielders Head Office is located at 15 Railway
Terrace, Mile End South SA. ABN 49091954442
FIELDERS Australia Pty Ltd reserves the right to use the information provided by competition applicants on
the entry form in future marketing and promotional related activities. Due care will be exercised to ensure the
contact details of the applicant will remain confidential at all times during
such activities.
k. Provision for Licence Numbers
In accordance with the Lottery and Gaming Act of 1936 and
the Lottery and Gaming Regulations of 1993, Fielders is authorised to conduct
this competition under.
